Scope
The following terms and conditions apply to all orders placed through our online shop. Our online shop is aimed exclusively at consumers.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither related to their commercial nor their independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their commercial or independent professional activity.

 

Contracting Party, Conclusion of Contract, Correction Options
The purchase contract is concluded with Maria Roberta Russi Musetti.

By listing products in the online shop, we make a binding offer to conclude a contract for these items. You can initially add our products to the shopping cart without obligation, and you can correct your entries before submitting your binding order by using the correction options provided and explained in the order process. The contract is concluded when you accept the offer for the items in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation via email.

We store the contract text and send you the order details and our terms and conditions in text form. You can view the contract text in your customer login.

 

Delivery Conditions
In addition to the prices of the products, shipping costs and customs duties may apply for deliveries outside the European Union. For more details on potentially applicable shipping costs, please refer to the offers.

We only deliver via shipping. A self-pickup of the goods is unfortunately not possible.

 

Payment
The following payment methods are generally available in our shop:

• Credit Card
  By placing the order, you provide your credit card details. After your authentication as the rightful cardholder, the payment transaction is automatically processed and your card will be charged.

• PayPal
  During the order process, you will be redirected to the PayPal website. To pay the invoice amount via PayPal, you need to be registered there or register, authenticate with your login credentials, and confirm the payment instruction to us. After placing the order in the shop, we will prompt PayPal to initiate the payment transaction. The payment transaction will then be processed automatically by PayPal. Further instructions will be provided during the order process.

• Klarna
  After completing your order, you will be redirected to the Klarna page where you can confirm your payment conveniently.

• Giropay
  After placing the order, you will be redirected to your bank's website. To pay the invoice amount via Giropay, you must have an online banking-enabled bank account, authenticate accordingly, and confirm the payment instruction to us. Further instructions will be provided during the order process. The payment transaction will be processed immediately and your account will be charged.

Retention of Title

The goods remain our property until full payment is made.

 

Transport Damage
If goods are delivered with obvious transport damages, please report such errors to the carrier as soon as possible and contact us immediately. Failure to file a complaint or contact us will not affect your statutory rights, especially your warranty rights. However, it helps us make our own claims against the carrier or transport insurance.

 

Warranty and Guarantees
Unless expressly stated otherwise below, the statutory liability for defects applies.
For used goods: if the defect occurs after one year from delivery of the goods, warranty claims are excluded. Defects occurring within one year from delivery of the goods can be asserted within the statutory limitation period of two years from delivery of the goods.
The above restrictions and time limitations do not apply to claims due to damages caused by us, our legal representatives, or vicarious agents: • In case of injury to life, body, or health • In case of intentional or grossly negligent breach of duty, as well as fraud • In case of violation of essential contractual obligations, the fulfillment of which enables the proper performance of the contract and on the adherence to which the contractual partner may regularly rely (cardinal obligations) • Within the scope of a guarantee, if agreed upon, or • If the scope of the Product Liability Act is opened.

Liability
For claims due to damages caused by us, our legal representatives, or vicarious agents, we are always fully liable: • In case of injury to life, body, or health • In case of intentional or grossly negligent breach of duty • In case of guarantee promises, if agreed upon, or • If the scope of the Product Liability Act is opened.

In case of breach of essential contractual obligations, the fulfillment of which enables the proper performance of the contract and on the adherence to which the contractual partner may regularly rely (cardinal obligations) due to slight negligence by us, our legal representatives, or vicarious agents, the liability is limited to the foreseeable damage at the time of contract conclusion, which is typically expected to occur.

In other cases, claims for damages are excluded.

 

Dispute Resolution
The European Commission provides an online dispute resolution (ODR) platform, which you can find here. We are not obligated and unwilling to participate in a dispute resolution procedure before a consumer dispute resolution body.
